VICTORVILLE • A 17-year-old girl convicted of stabbing another teen girl with a knife during a melee in a Victorville neighborhood received the maximum possible prison term Friday.

Judge Jules Fleuret sentenced Kaieesha Franklin to 13 years in prison. Fleuret said she should get the aggravated term for the attempted murder conviction because she left the scene to get a knife and caused grave impact on the then-13-year-old victim.

“The tragedy of this case is it rose out of very juvenile conduct by adults,” Fleuret said, adding that it’s unfortunate adults involved in the fight cannot serve some of Franklin’s time.

“I blame it on adults as much as Miss Franklin,” he said.

On June 9, the victim and other children got into a scuffle playing kickball in the 15000 block of Fairbanks Drive before their adult family members joined in, San Bernardino County Sheriff’s officials said.

The victim testified she got into a fight with Franklin, who went into her uncle’s house and came back with her right hand behind her back. Franklin struck her, the victim said, and the girl realized she was bleeding.

Franklin testified she was fighting in the melee to protect her sister but never stabbed the victim. Franklin’s defense attorney during the trial argued no one saw her with the knife — even the victim.

The defendant, who was charged as an adult, cried hysterically after she heard the guilty verdict in September, while her mother collapsed on the floor. Franklin asked for a new trial, and Fleuret appointed the public defender’s office to review the trial.

But Deputy Public Defender David Sanders informed the court Friday that Franklin’s trial lawyers made no legal errors.

The victim and her parents made impact statements before the sentencing, telling the judge the scars not only damaged her appearance but also instilled fear in the young girl.

The victim was crying as she walked up in front of the judge to read her statement. In a weak voice, she said she thought she was going to die, but couldn’t continue her speech. Deputy District Attorney Lisa Crane read the rest of the statement.

Franklin has to serve at least 85 percent of her prison term before she becomes eligible for a release, Sanders said.

“I didn’t really expect (the judge) to give her the aggravated term,” Sanders said. “I thought there was a really good argument for the low term because it was her first conviction.

“I don’t think any juvenile should be brought to adult court,” Sanders continued. “Anyone who has a child knows that children should be treated as children.”

BEIJING (Reuters) - China's military warned the United States on Saturday that U.S.-Philippine military exercises have raised risks of armed confrontation over the disputed South China Sea in the toughest high-level warning yet after weeks of tensions.

China's official Liberation Army Daily warned that recent jostling with the Philippines over disputed seas where both countries have sent ships could boil over into outright conflict, and laid much of the blame at Washington's door.

This week American and Filipino troops launched a fortnight of annual naval drills amid the stand-off between Beijing and Manila, who have accused each other of encroaching on sovereign seas near the Scarborough Shoal, west of a former U.S. navy base at Subic Bay.

The joint exercises are held in different seas around the

Philippines; the leg that takes place in the South China Sea area starts on Monday.

"Anyone with clear eyes saw long ago that behind these drills is reflected a mentality that will lead the South China Sea issue down a fork in the road towards military confrontation and resolution through armed force," said the commentary in the Chinese paper, which is the chief mouthpiece of the People's Liberation Army.

"Through this kind of meddling and intervention, the United States will only stir up the entire South China Sea situation towards increasing chaos, and this will inevitably have a massive impact on regional peace and stability."

Up to now, China has chided the Philippines over the dispute about the uninhabited shoal known in the Philippines as the Panatag Shoal and which China calls Huangyan, about 124 nautical miles off the main Philippine island of Luzon.

China has territorial disputes with the Philippines, Vietnam, Brunei, Malaysia and Taiwan across the South China Sea, which could be rich in oil and gas and is spanned by busy shipping lanes.

Major General Luo Yuan, a retired PLA researcher well-known for his hawkish views, amplified the warnings from Beijing issued through state media.

"China has already shown enough restraint and patience over this incident," Luo said of the friction with Manila, according to an interview published on Chinese state television's website (http://news.cntv.cn).

If the Philippines "takes irrational actions, then the current confrontation could intensify, and the Chinese navy will certainly not stand idly by," he added.

REGIONAL TENSIONS

Beijing has sought to resolve the disputes one-on-one with the countries involved but there is worry among its neighbors over what some see as growing Chinese assertiveness in staking claims over the seas and various islands, reefs and shoals.

In past patches of tension over disputed seas, hawkish Chinese military voices have also risen, only to be later reined in by the government. The same could be true this time.

Since late 2010, China has sought to cool tensions with the United States. Especially with the ruling Chinese Party preoccupied with a leadership succession late in 2012, Beijing has stressed hopes for steady relations throughout this year.

Nonetheless, experts have said that China remains wary of U.S. military intentions across the Asia-Pacific, especially in the wake of the Obama administration's vows to "pivot" to the region, reinvigorating diplomatic and security ties with allies.

The Liberation Army Daily commentary echoed that wariness.

"The United States' intention of trying to draw more countries into stirring up the situation in the South China Sea is being brandished to the full," said the newspaper.

ATLANTA (Reuters) - The U.S. Food and Drug Administration said on Saturday it now spends as much effort and resources on surveilling a drug after it is approved as it does in the pre-approval process.

The FDA was responding to critics who say the agency is toothless when it comes to tracking the safety of drugs already on the market, when industry funds that supported pre-approval reviews tend to dry up.

"We think we've really balanced this," Dr. Janet Woodcock, director of the agency's Center for Drug Evaluation and Research, told reporters attending the Association of Healthcare Journalist meeting in Atlanta.

In a report released on Saturday, the FDA says it has required companies to do 385 post-market studies since 2008, and to change the label based on new safety information 65 times.

Before 2008 the FDA could not compel label changes or require additional safety trials and had to rely on voluntary action from drugmakers, she said.

The FDA's focus on post-market drug safety comes after the agency was sharply criticized as being slow to respond to drug side effects, notably Vioxx, a painkiller that Merck & Co Inc pulled five years after approval because of a link to heart attacks and strokes.

A 2006 report from the Institute of Medicine, an independent research body that advises the government on scientific matters, found the FDA needed to do more to police the safety of medicines after they reach the market.

Congress later gave the FDA more power to oversee drugs after approval, such as ordering companies to change their labels or conduct additional safety trials, and fining them if they fail to do so.

But critics question how often the agency actually follows through on penalties.

In 2008 the FDA also launched Sentinel, a computer tracking system designed to help identify problems with drugs and medical devices already on the market by searching various databases for possible side effects - rather than just relying on voluntary reports from companies and patients.

The FDA said it used the system to see if there were negative drug interactions for Chantix, the smoking cessation drug manufactured by Pfizer Inc, but did not find any.

Last November U.S. researchers said Chantix carried too many risks and should only be tried when other treatments fail.

The findings, which Pfizer said were flawed, contradicted two studies released in October by the FDA that showed Chantix (sold as Champix outside the United States) did not increase the risk of being hospitalized for psychiatric problems such as depression.

The agency at the time acknowledged those studies were flawed because they were too small to identify rare events and captured only cases severe enough to land people in the hospital.

Woodcock could not immediately provide examples of where Sentinel alerted the agency to safety information they had not been aware of before.

For today's video I had to go to my emergency files, I wanted to upload the nail design I had on Sunday's video. I tried getting home early all week long so that I would have time to edit the video & have it ready for you today, but I wasn't able to have it done.

NEW YORK (AP) — If you think texting while walking is dangerous, just wait until everyone starts wearing Google's futuristic, Internet-connected glasses.

While wearing a pair, you can see directions to your destination appear literally before your eyes. You can talk to friends over video chat, take a photo or even buy a few things online as you walk around.

These glasses can do anything you now need a smartphone or tablet computer to do —and then some.

Google gave a glimpse of "Project Glass" in a video and blog post this week. Still in an early prototype stage, the glasses open up endless possibilities — as well as challenges to safety, privacy and fashion sensibility.

The prototypes Google displayed have a sleek wrap-around look and appear nothing like clunky 3-D glasses. But if Google isn't careful, they could be dismissed as a kind of Bluetooth earpiece of the future, a fashion faux-pas where bulky looks outweigh marginal utility.

In development for a couple of years, the project is the brainchild of Google X, the online search-leader's secret facility that spawned the self-driving car and could one day send elevators into space.

If it takes off, it could bring reality another step closer to science fiction, where the line between human and machine blurs.

"My son is 4 years old and this is going to be his generation's reality," said Guy Bailey, who works as a social media supervisor for a university outside Atlanta, Ga. He expects it might even be followed by body implants, so that in 10 years or so you'll be able to get such a "heads-up display" inside your head.

But is that what people want?

"There is a lot of data about the world that would be great if more people had access to as they are walking down the street," said Jason Tester, research director at the nonprofit Institute For the Future in Palo Alto, California.

That said, "once that information is not only at our fingertips but literally in our field of view, it may become too much."

Always-on smartphones with their constant Twitter feeds, real-time weather updates and "Angry Birds" games are already leaving people with a sense of information overload. But at least you can put your smartphone away. Having all that in front of your eyes could become too much.
